Cox Hallett Wilkinson advises Hypo Real Estate Capital Corporation in relation to US$400m acquisition financing

October 2007

Cox Hallett Wilkinson (“CHW”) has advised Hypo Real Estate Capital Corporation (“Hypo”) in relation to a US$400 million financing of the acquisition of the Fairmont Hamilton Princess in Hamilton, Bermuda and the Fairmont Acapulco Princess and Fairmont Pierre Marques in Acapulco, Mexico.

The CHW team of Ernest Morrison, Harry Kessaram, Jonathan Betts and Natalie Town advised on the Bermuda aspects of the financing which was provided by Hypo for the purposes of facilitating the acquisition of the three hotels by Goodman Hospitality Investments.

The US legal advisers to Hypo were Dechert LLP with Greenberg Traurig, LLP (US counsel) and Conyers Dill & Pearman (Bermuda counsel) advising the borrower group.

Ernest Morrison commented “We are very pleased to have acted as Bermuda counsel to Hypo on this financing.  The Fairmont Hamilton Princess is an iconic property on the island that has serviced business and leisure travelers for over 120 years.  The financing was highly structured with many Bermuda law issues to be handled by the team”.
